Terms of Service

1. Agreement to Terms

These Terms of Service govern your use of Wyza. By accessing our platform or clicking "I agree", you agree to these terms.

2. Description of the Platform

Wyza is a digital survey and polling platform that:

  • Allows individuals to participate in surveys and polls;
  • Allows organisations, brands, and individuals to create, distribute, and manage surveys;
  • May provide incentives or rewards for survey participation, subject to eligibility and verification.

Wyza does not guarantee:

  • Availability of surveys,
  • Frequency of survey invitations
  • Amount or continuity of rewards or earnings.

3. Eligibility and Age Requirement

We collect personal data that is reasonably necessary to operate the Platform, deliver services, and administer surveys.

3.1 You must be at least eighteen (18) years old to use the Platform. Wyza reserves the right to suspend or terminate any account found to be operated by a minor.

3.2 By using the Platform, you represent and warrant that:

  • You are legally competent to enter into a binding agreement; and
  • You are not prohibited from using the Platform under applicable laws.

4. Account Registration and Verification

4.1 To access the Platform, you must create an account using a valid phone number (mandatory). Phone number verification is conducted via One-Time Passwords (OTP) sent through Africa's Talking.

4.2 You agree to provide accurate, complete, and up-to-date information at all times. One account per user is permitted. Creating multiple accounts is strictly prohibited.

4.3 You are solely responsible for:

  • Maintaining the confidentiality of your account credentials; and
  • All activities carried out under your account.

Wyza is not liable for any loss resulting from unauthorised access caused by your failure to secure your account.

5. User Obligations and Acceptable Use

Users should maintain the confidentiality of your credentials and monitor activity under your account.

By using the Platform, you agree that you will not:

  • Provide false, misleading, or inaccurate information when registering and updating your account;
  • Submit fraudulent, duplicate, or automated survey responses;
  • Manipulate survey outcomes or reward systems;
  • Abuse messaging or WhatsApp flows;
  • Create or operate multiple accounts;
  • Harass, threaten, or harm other users;
  • Impersonate another person;
  • Upload unlawful, abusive, defamatory, or infringing content;
  • Use the Platform for any illegal or unauthorised purpose;
  • Attempt to interfere with, reverse-engineer, or disrupt the Platform.
  • Violate our Acceptable Use Policy and other applicable policies.

Wyza reserves the right to investigate violations and take enforcement action, including suspension or permanent termination, without notice.

6. Surveys and User Content

6.1 Users may be invited to participate in surveys that require:

  • Text responses,
  • Audio recordings,
  • Video recordings,
  • WhatsApp-based responses
  • Images or file uploads.

By submitting media, you confirm:

  • You have the right to share the content
  • You consent to AI processing such as transcription, language detection, and validation
  • Your responses may be reviewed for quality and authenticity

6.2 Participation in any survey is voluntary. You may decline to participate in any survey that requests information you do not wish to provide.

When you participate in a survey:

  • You agree to answer honestly and to the best of your ability
  • You may be required to meet eligibility criteria
  • Some surveys allow only one response per user

Submitting a response does not automatically guarantee acceptance, reward, or payment.

6.3 You represent and warrant that all content you submit:

  • Is truthful and accurate to the best of your knowledge;
  • Does not infringe third-party rights;
  • Does not violate any law or regulation.

7. Intellectual Property Rights

7.1 All rights, title, and interest in the Platform, including software, branding, design, and proprietary materials, belong to Wyza. Wyza will not publicly disclose your identity in connection with survey responses without your consent.

7.2 You retain ownership of your survey responses. However, by submitting content, you grant Wyza a non-exclusive, royalty-free, worldwide license to:

  • Use, process, analyse, and aggregate such content;
  • Share anonymized or non-identifiable data with survey creators or partners.

8. Payments, Rewards, and Payouts

8.1 Some surveys may offer monetary or non-monetary rewards.

8.2 Rewards are subject to:

  • Survey completion;
  • Quality checks;
  • Compliance with survey rules and validation.

8.3 Wyza uses Stripe for payment processing. Payouts are subject to Stripe's terms and processing timelines. Wyza reserves the right to withhold rewards for fraudulent or low-quality responses, and reverse rewards obtained through violation of these Terms. Wyza does not guarantee payment eligibility or minimum earnings.

9. Account Suspension and Termination

9.1 Wyza may suspend or terminate your account immediately if you violate these terms, fraudulent or abusive activity is detected and as required by law or regulatory authorities.

9.2 Upon termination:

  • Your access to the Platform ceases immediately;
  • Any pending rewards may be forfeited;
  • You may not create a new account without written permission.

10. Account Deletion by User

10.1 You may delete your account at any time using in-app settings or by contacting support. Account deletion is permanent and irreversible.

10.2 Upon deletion:

  • Your account is deactivated;
  • Access to the Platform is revoked;
  • Personal data is permanently erased in accordance with our Privacy Policy;
  • Any unused rewards or balances are forfeited.

We do not sell personal data to advertisers.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available."

Wyza makes no warranties, express or implied, including but not limited to fitness for a particular purpose, accuracy of surveys and availability or reliability of the Platform. Use of the Platform is at your own risk.

12. Limitation of Liability

Wyza and its affiliates are not liable for indirect damages, including lost profits, data loss, or business interruptions resulting from platform use.

13. Indemnification

You agree to indemnify and hold harmless Wyza from any claims, damages, losses, or expenses arising from your misuse of the Platform, violation of these Terms and violation of any law or third-party rights.

14. Modifications of the Terms

Wyza may update these Terms from time to time. Material changes will be communicated via the Platform or email. Continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes are subject to arbitration in Nigeria under the relevant arbitration rules.
